    Disneyland worker seeks legal help to sue theme park over injury

    Hong Kong- A 22-year old former Disneyland theme park worker is seeking legal aid to sue the park for alleged negligence after sustaining injuries while performing in a Buzz Lightyear costume, a media report said Friday. If the application is granted, it will be the first injury claim against the park since the facility opened last September, the South China Morning Post said.

    According to a doctor's certificate, the performer, identified only as Michael, suffers pain in his neck, back and thigh from wearing the heavy costume, especially the head.

    He played the role of the Toy Story character between September and July when he was sacked after taking six weeks' sick leave.

    Explaining how the neck injuries were caused, Michael said: "We have to lower our heads all the time because we look through the mouth of the character. On top of all the nodding and dancing, our necks are subjected to extra pressure when kids press down on us."

    The pain intensified over the summer when he performed in five or six parades a week. "Sometimes I woke up at four in the morning shivering with pain, but whenever I got back to my duties from sick leave I was still asked to attend the parade twice a day," he added.

    He was sacked on July 31 after he returned to work after a week of unpaid sick leave.

    Hong Kong Disneyland human resources senior vice-president Kerry Chandler said Michael was sacked following an evaluation of work-related factors, including attendance, performance and conduct. His dismissal was not related to the injuries, Chandler said.

    Physically, Chinese are not as strong / tall as their American / European counterparts. This is the reason why Chinese character performers are much easier to get injured. Disney needs to adjust their character costume design in HKDL in order to cope with the physically characteristics of Asians.

    There is no point to sack an employee simply because work related injury. How bad if an employer not to compensate the staff but just fire him? It is just normal for an injured person to take some rest for recovery and I don’t think it should be something related to "attendance".

    Another interesting point is HKDL has an American to be their head of HR. Will Chandler knows more than the local talents in terms of local labor market environment, practices, employment requirements, labor ordinances and even physical conditions of local people?

      So are you saying that Disney has also altered the costumes for Tokyo DL, since Asians don't have the same physical characteristics as Americans and Europeans?

      And who is to say that Chinese or Asians don't work as characters in the American parks too? Sorry that excuse doesn't hold up with me. That one performer perhaps couldn't or shouldn't handle the weight of the costume, but I don't believe they need to modified for any particular race. The same is true for many Americans who could not properly wear a heavy costume.

        I just have to say that hearing the term sacked instead of fired is so much better. I think we Americans should adopt that term instead. I laugh everytime I hear about someone being sacked.

          Exactly, I know of at least two small asian girls who have been characters at Disneyland. And the Mickeys in Fantasmic at one point were all asian girls. Maybe they should sent them to HKDL to show them how to do it, but then again this is probably an isolated incident.
