  • Legalities of using the Disney name and logo

I was looking into possibly starting a small online business using the Disney name and the Disney typeface in the logo.

I know that both of these are copyrighted by Disney, but I was wondering if companies unaffiliated with the Walt Disney Co are allowed to use this at all?

Is it simply a "no" situation and it is not allowed, or would it be legal if we clearly note on the website that we are in no way affilliated with the Walt Disney Company or any of its affiliates?

Any lawyers out there? Or at least anybody familiar with things like this?

I don't know for sure, but I'm guessing its a pretty big NO. They are very protective of their intelectual property. Schools can't even (legally) show Disney movies in class or have Disney character pictures as decorations in a room without running afoul of copywrite laws. Personally, I wouldn't chance it.

Ha, I've watched so many Disney movies in schools. I thought the law was you can't show them legally unless its FREE and PRIVATE USE. Is a classroom not private use? It's not like random people can just walk in and start watching.

That's why I changed my site name to MouseStreetUSA. It was Disneyland Info. Someone bought the domain for DisneylandInfo.com and they used the Disney font all over their site and even on their CafePress shop. Big no-no on CafePress. Oh, well.

I heard that Disney only agreed to not go after the tattoo guy as long as he doesn't display his art in certain mags/events. Otherwise, off they go...OUCH!

To bad Disney can't just be happy with the fact that he is a big fan of them. Can't we all just get along? LOL.

Plainly said, don't use the Disney name or typface (especially for a business). If Disney catches you doing this, you'll get a cease and Desist letter (followed by legal actions). Disney doesn't really care what you do with the name, it's the mere fact that your using it (for a business) that will get you in trouble from them.

and businesses that got in trouble and changed logos and such...

Disney will go after the little guy for using stuff they own...

This is why I changed the logos on my Virtual Disneyland to VirtualDL

Unusually and exceedingly peculiar and altogether quite impossible to describe...

Using copyrighted material in a for profit situation is a big no in all cases. That is the whole purpose of the copyright. And of course tempting Dinsey is just asking for trouble.
