  • are websites illegal or their content?

    I've always wondered this:

    Websites like Limewire and 4chan are notorious for having illegal content on their websites (be it music downloads or illegal photos) and still TONS of people go to the websites.

    How are these people not been getting in trouble?

    A few are getting in trouble. But to the point - Neither the site nor the content is illegal in and of themselves. Posting copyrighted content on the site without permission is what is illegal. Obtaining (downloading) copyrighted material without permission of the copyright holder or holder's agent is illegal.

    So having copyrighted content without holders consent or downloading said content from the site is illegal - and people who run the sites and people who download from them are being prosecuted. The reason not everyone is caught is as you said - there are tons of people. Too many to catch them all. Often the sites themselves try to skirt the law by having their physical presence in a country that does not recognize copyrights from other countries or does not prosecute or extradite.

    You always download at your own risk - you are rolling the dice.

      So basically if you go to limewire or similar sites and download uncopyrighted material...say something someone posted they made themselves...like their own singing or whatever.... no laws are broken there?

        Correct.

        There are a lot of legal battles going on right now over copyright law. Mainly because our copyright law was written long before the internet and doesn't take into account digital media at all. There are lots of issues that will have to be hammered out in the coming years. Even including the text of an email that you are replying to is considered copyright infringement if you don't have the permission of the person who wrote it originally. Sounds crazy, but it is true. Written works are copyrighted upon completion to the author. ALL written works. Replying in that manner is punishable by UP TO $16,000. So while current laws may not make much sense in light of current technology, they are still the law.

          Its very interesting with the laws.

          I have always wondered about downloads on Limewire and the notorious 4chan...why would you risk it by evening visiting the website?
          I have heard people have been prosucuted for viewing illegal photos (not downloading) and not reporting and getting videos, like on Pirates Bay.

          idk...I try to be safe as possible on the internet. micechat is my main site besides facebook.

            As far as I am aware, being prosecuted for just looked at images is limited to things like child pornography. That is not a copyright issue, but a specific case where looking at those types of images, regardless of medium or if it is downloaded onto your local hard drive, is illegal.

              Ive heard of that but also like bomb making or actual crimes like murder is illegal? I heard 4chan had alot of that kind of bad stuff, which made me wonder why people go there in the first place...

                4chan is a very diverse website, and they do in fact moderate it because the owners don't want it getting shut down. I dislike the interface and don't go there, but it is a well known fact that the now world famous "lolcat", "Rickroll" and "O RLY?" phenomena started on 4chan, so not everything that comes out of there is "evil". 4chan has also done a lot for animal rights, for better or worse, by hunting down people who are seen in internet videos doing such horrible things as kicking puppies off of cliffs and making sure they end up in jail.

                The part of 4chan everyone thinks of when they think 4chan is /b/, best thought of as a late night biker dive bar frequented by biker gangs who love cats, if you can't hold your own against the sometimes outright hostile environment, don't go in

                So....why do people go to 4chan? Because they want to talk about stuff, same reason we come here. There are boards for technology, anime, video games, and *cough* more grown up interests. It's just another website, albeit one with a more notorious reputation.
